INFORMATION pursuant to Legislative Decree. n. 196 of 06.30.2003

pursuant to art. 13 of Legislative Decree no. 196 of 30.6.2003 (Privacy Code) we wish to inform you that your personal data, including your e-mail address, which you will spontaneously send to the e-mail addresses: info@otticamolineris.it or through one of the forms in this site, will be processed by Ottica Molineris Srl in compliance with the aforementioned legislation.

According to the provisions of Legislative Decree no. 196/2003, data processing is carried out in compliance with the principles of correctness, lawfulness, transparency and protection of your privacy and your rights. Ottica Molineris Srl wishes to inform the User of the following:

The User's personal data provided during commercial relationships and/or for carrying out promotional activities or in the formation of contractual relationships will be processed:

a) for purposes functional to the fulfillment of tax, accounting and legal obligations; for the purposes of mere exchange of information and contacts of a commercial nature or for the management of pre-contractual negotiations based on a possible request from the User to benefit from the offers of Ottica Molineris Srl; for the purpose of fulfilling obligations deriving from contracts stipulated with customers; for the supply of products and accessories, assistance, replacement, repair, including after-sales; customer management and administration, orders, shipments, issuing invoices, solvency checks;

b) for purposes related to commercial activity (marketing and advertising, promotional activities and information on future commercial initiatives, innovation of the services offered);

The data communicated by the User may be communicated to tax consultants and banks for the management of collections and payments deriving from the execution of the authorized contract.

The data may also be communicated, following inspections or checks, to the bodies responsible for verifying the regular fulfillment of civil and fiscal obligations.

The provision of the essential personal data referred to in point a) is mandatory for the purposes of fulfilling legal obligations and/or the establishment and/or fulfillment of the contractual relationship. In the absence of the provision of the data referred to in point a) it will be impossible to establish and/or proceed with the contractual relationship.

The provision of personal data referred to in point b) is optional and functional to providing a better customer service. In case of refusal there will be no consequences.

The personal data concerning the User may be communicated to other companies for the same purposes as above or to external parties specialized in:

- management of software, hardware, telematic and information systems;
- data processing and storage activities;
- printing, transmission, packaging, transport and sorting of goods to customers;

The processing operations will be carried out both manually and with the aid of IT and telematic means. In fact, the data may be stored both in paper archives and in electronic archives, so as to allow, where necessary, the identification and selection of aggregate data, for a time not exceeding the duration and needs of the processing. The processing will be carried out directly by the owner's organization, with the help of its representatives.
It will take place with logic strictly related to the purposes indicated and with methods that guarantee the security and confidentiality of the data itself, through the adoption of suitable measures to prevent alteration, cancellation, destruction, unauthorized access or processing. not permitted or not compliant with the purposes of the collection.

To proceed with the purchase of eyeglasses or sunglasses with graduated lenses, the User must provide the data contained in the medical-ophthalmology prescription, expressly consenting to the processing of sensitive data by Ottica Molineris Srl.
                  
If the User sends personal and sensitive data of any third party (purchase of glasses with graduated lenses on behalf of a third party), he/she acknowledges that this operation represents a processing of personal data for which he/she acts as an independent owner, consequently assuming all obligations and responsibilities provided for by the Privacy Code; in this sense, the User guarantees to Ottica Molineris Srl that any data of third parties that is indicated by the User (and consequently will be treated by Ottica Molineris Srl as if the third party had provided informed consent to the processing of their data personal and sensitive) was acquired and processed by the User in compliance with and in accordance with the provisions of the Privacy Code and with the express authorization of the third party; in this sense, the User grants Ottica Molineris Srl the broadest indemnity with respect to any dispute, claim, request for compensation for damage resulting from treatment, which may reach Ottica Molineris Srl from any interested third party due to the incorrect provision of the data indicated by the User in violation of the rules on the protection of personal and sensitive data.

We inform the User, who by continuing with the purchase accepts that the execution of the contractual relationship involves the transmission of personal data and if necessary also sensitive data to subjects external to Ottica Molineris Srl, including the company's staff responsible for packaging and shipping (for Users from EU member states), as well as the personnel in charge of the company in charge of transport and also the personnel in charge of the competent administrative and fiscal bodies, pursuant to national regulatory requirements of primary or secondary rank and /or the consequent administrative and fiscal provisions (for Users from non-EU States).

By subscribing to the Newsletter, the User consents to the processing of the personal data provided and authorizes Ottica Molineris Srl to process the data for activities with marketing purposes, for sending promotional material and for the purpose of profiling products that can be purchased on the Ottica Molineris Srl website.

The User is informed that the personal data may also include their image.
The User is informed that the acquired images will be stored in third-party computer storage, appropriately identified by Ottica Molineris Srl.


The User is made aware of the fact that data transmission via the Internet cannot achieve absolute levels of security.
It is therefore the User's responsibility to verify the correctness of the personal data concerning him and, if necessary, rectify, update or, in any case, modify them during the processing. Star Srl cannot in fact be considered obliged to perform any other performance other than the timely and correct application of the safety standards imposed by the legislation in force.

Article 7
(Right of access to personal data and other rights)

1. The interested party has the right to obtain confirmation of the existence or otherwise of personal data concerning him, even if not yet registered, and their communication in an intelligible form.

2. The interested party has the right to obtain the indication:
a) the origin of the personal data;
b) the purposes and methods of processing;
c) of the logic applied in case of processing carried out with the aid of electronic instruments;
d) the identification details of the owner, managers and representative designated pursuant to article 5, paragraph 2;

e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representatives in the territory of the State, managers or agents.

3. The interested party has the right to obtain:
a) the updating, rectification or, when interested, integration of the data;
b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
c) certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which this requirement is proves impossible or involves a manifestly disproportionate use of means compared to the protected right.


4. The interested party has the right to object, in whole or in part:
a) for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection;
b) to the processing of personal data concerning him for the purposes of sending advertising or direct sales material or for carrying out market research or commercial communication.


To exercise the rights provided for in the art. 7 of Legislative Decree 196/2003, summarized above, the interested party must send a written request addressed to:

In particular, each interested party may in any case exercise, at any time, by sending an e-mail addressed to Ottica Molineris Srl , the right to object in whole or in part to the processing provided for the purposes of commercial information or sending of material. promotional, direct sales or for carrying out market research or interactive commercial communication.

For each request pursuant to art. 7, paragraphs 1 and 2 letters a), b), and c), of the Legislative Decree. 196/2003, Ottica Molineris Srl may request from the interested party, where the existence and accuracy of the data concerning him or her is not confirmed, an expense contribution, not exceeding the costs actually borne, according to the methods and within the limits established by the regulation issued, pursuant to art. 10 paragraph 8 of the Legislative Decree. 196/2003.

By sending electronic confirmation of your purchase order or by sending information requests via e-mail, the User takes note of the above information and consents to the processing of personal data provided in the ways and terms indicated in the letters. a) and b) of this Information.
With reference to glasses with graduated lenses, the User, by entering his prescription and sending the confirmation of his order electronically, takes note of the above information and consents to the processing of his personal and sensitive data spontaneously provided.

Ottica Molineris Srl is not responsible for the provision of unsolicited data to the User and in particular for data that the User accidentally provides following incorrect use of the functionality relating to the measurement of the interpupillary distance. In any case, Ottica Molineris Srl will not process in any way the unsolicited data fortuitously provided by the User.

The user is informed that the data controller may modify and update the privacy policy, in order to implement and comply with any regulatory changes that may arise.

Pursuant to Chapter IV, art. 25, c. 6 "Transfer of personal data to third countries" of Directive 95/46/EC, the data may be transferred to countries not belonging to the EU or the European Economic Area which, however, guarantee an adequate level of protection of personal data. In any case, the processing will take place according to the methods established by this information and the provisions of the law.
